Scope. This Universal Email Policy (this "Policy") governs the usage of Apvio, Inc's products and services ("Apvio Services") in regards to email. This Policy is incorporated by reference into each contract Apvio enters into with a customer (each, a "Customer") for the use of such Services. Apvio may modify this Policy at any time without notice. In addition, this Policy is incorporated by reference into the Terms and Conditions applicable to Apvio's Web site so that no person who uses, or causes to be used Apvio Services, or computer resources hosted by or connected to Apvio Services (collectively, "the Apvio Network") regardless of whether that person is a Customer may take any action utilizing Apvio Services and Apvio Network that a Customer would be prohibited to take utilizing the Services.
Certain Apvio Services may have additional spam guidelines explaining appropriate conduct for those services. Those additional policies are incorporated by reference into the Apvio Universal Email Policy. It is the user's responsibility to check each services guidelines for additional details regarding spam.

Purpose. The purpose of this Policy is to enhance the quality of Apvio Services and to protect Apvio's customers, and the Internet community as a whole, from illegal, irresponsible, or disruptive use of email. This Policy applies to each Customer and its employees, agents, contractors or other users of such Customer who obtain Apvio Services, and Non-Customers who use or cause the use of Apvio Services (each such being a "User").

Prohibited Uses. Users may not:
- Use Apvio Services in connection with mass unsolicited email or newsgroup messages (commercial or otherwise). Without limiting the general application of this rule, Users may not:
- Use Apvio Services to send large numbers of unsolicited email messages to advertise, offer, sell, or buy any goods or services, or for informational announcement. In response to a complaint, Apvio has the discretion to determine, from all of the evidence it receives, whether the intended recipients were from an "opt-in" email list.
- Use Apvio Services to post large numbers of inappropriate newsgroup messages (excessive cross-posting or multiple-posting) to advertise, offer, sell, or buy any goods or services, or for informational announcement.
- Use Apvio Services to send email with forged headers to deceive or mislead other persons regarding the true identity/origin oF the sender.
- Use Apvio Services to host email addresses used as a drop or reply point in mass unsolicited email or newsgroup posts.
- Use Apvio Services to host servers, web sites, or web pages advertised in mass unsolicited email or newsgroup posts.
- Use another site's mail server to relay mail without the express permission of the site.
- Use Apvio Services to distribute, advertise or promote software or services that have the primary purpose of encour
aging or facilitating unsolicited email or spam;
- Use Apvio Services to solicit or collect, or distribute, advertise or promote, email address lists for the purpose
of encouraging or facilitating unsolicited email or spam;
- Cause the use of Apvio Services in connection with mass unsolicited email or newsgroup messages (commercial or otherwise). Without limiting the general application of this rule, Users may not:
- Send large numbers of unsolicited email messages to advertise, offer, sell, or buy any goods or services, or for informational announcement to addresses or domains on the Apvio Network. In response to a complaint, Apvio has the discretion to determine, from all of the evidence it receives, whether the intended recipients were from an "opt-in" email list.
- Send email with forged headers (to deceive or mislead other persons regarding the true identity/origin of the sender) to addresses and domains on the Apvio Network.
- Use a mail server on the Apvio Network to relay mail without the express permission of the mail server administrator.
- Use an email address or domain on the Apvio Network without the express permission of the domain owner.

Use Apvio Services to maintain mail servers configured as "open relays". An open relay is a mail server that allows anyone from anywhere on the Internet to send email through it to a remote recipient. When a mail server is an open relay, third-parties (i.e. spammers) will often use the mail server and the Internet connection it uses to send unsolicited email in bulk.
- To prevent abuse and ensure a high quality of service Customers who maintain their own mail servers to send and receive email through the Apvio Network must configure their mail servers as "closed relays", to prevent third-party relaying.
- Customers whose mail servers are acting as open relays will be required to reconfigure them as closed relays.
- Apvio reserves the right to test the status of mail servers for open relays.
- Apvio reserves the right to suspend and/or terminate service where a customer fails to close an open relay.
- Apvio reserves the right to suspend service and/or block mail related ports immediately and without prior notice where the Customer's mail server is actively being used to send bulk unsolicited email.
- A mail server needs to have the following characteristics to prevent third-party relaying, and be considered a "closed relay".
- It should only accept incoming mail that it delivers locally, based on email address.
- It should only deliver outgoing mail that originates from an authenticated user. User authentication can be achieved by requiring users to use SMTPA, POP before SMTP, or connecting from a known block of IP addresses (on network).

Violations. Violations of our Terms of Service or this Universal Email Policy may result in legal action against you and the termination, without notice, of any Apvio Services you may have and anything associated with it. Nothing in this policy is intended to grant any right to transmit email to or through Apvio computer systems. Apvio does not waive any rights by the failure to enforce this policy in every instance in which it might apply.
NOTICE: Sending mass unsolicited email to or through Apvio computer systems or using email addresses or domains hosted by Apvio will use or cause to be used Apvio computer systems located in the state of Washington. Any unauthorized use of Apvio computer systems is a violation of the Apvio Terms of Service, Universal Email Policy, Acceptable Use Policy and certain federal and state laws, including the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.), and Chapter 19.190 of the Washington State Code. Such violations may subject the sender and his or her agents to civil and criminal penalties.
